Terms of Service for NetDiag.dev network diagnostics API. Understand your rights and responsibilities when using our service.

TL;DR

  1. Use NetDiag for good, not evil – only for legal, authorized purposes (no misuse or illegal activity).
  2. NetDiag is provided "as is" – we strive for reliability but offer no guarantees or warranties if something goes wrong.
  3. We offer free and paid tiers. The free tier is for basic/personal use; if you need more or commercial use, please upgrade to a paid plan.
  4. Paid subscriptions can be canceled any time – no long-term commitments.

By using the NetDiag.dev website or API ("Service"), you agree to the following Terms of Service ("Terms"). If you are using NetDiag on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms. If you do not agree with these Terms, do not use the Service.

Account & Acceptable Use

  • Account Registration: You must provide a valid email address when signing up for an account. All information you provide should be accurate and current.

  • One Account Per User: You should not maintain multiple accounts to circumvent usage limits or for any deceptive purposes. Each user or organization is generally limited to a single account.

  • Account Security: You are responsible for maintaining the security of your account credentials and API keys. Keep your password and API key secret to prevent unauthorized access. Any actions taken using your credentials or keys are your responsibility, so notify us immediately if you suspect any unauthorized use.

  • Legal and Acceptable Use: You agree to use NetDiag only for lawful purposes. Do not use the Service to engage in illegal activities, to harass, disrupt, or gain unauthorized access to other systems, or in any way that violates applicable laws or regulations.

  • Authorized Targets: Use NetDiag only to run diagnostics on networks and systems that you own, control, or have permission to test. For example, if you use NetDiag to ping or check a domain or IP, you should be the owner or have the owner's consent to do so. Using the Service on third-party systems without permission is strictly prohibited.

  • Respecting Others' Rights: You must not use NetDiag in a manner that infringes or misappropriates the intellectual property or privacy rights of others. Do not attempt to reverse engineer or extract confidential data from our service or from any systems you probe using our service.

  • Notification of Breach: If you become aware of any unauthorized use of your account or API key, or any security breach relating to the Service, you agree to promptly notify NetDiag so we can help mitigate the issue.

Plans, Usage Limits & Payments

  • Service Tiers: NetDiag offers free and paid tiers. We may adjust the exact rate limits or features of each tier from time to time.

  • Fair Use of Free Tier: The free tier is provided to let users try and use NetDiag on a small scale. It is not intended for heavy or commercial use. Using the free Service for profit-generating or business-critical monitoring without a paid subscription is a violation of these Terms. If we detect commercial-level usage on a free plan, we may ask you to upgrade or limit/suspend your access.

  • Paid Subscription: By subscribing to a paid tier, you agree to pay the applicable subscription fees. Payments are handled via our third-party payment provider, Paddle. Subscription fees are charged in advance (e.g., monthly) and will automatically renew at the end of each billing cycle unless you cancel beforehand. Paddle may charge your provided payment method for each renewal term without further authorization, until you cancel.

  • No Long-Term Commitments: You can cancel your paid subscription at any time. Cancellation will prevent the next renewal charge, and your paid access will continue until the end of the period you've paid for. We do not lock you into long-term contracts. (For example, if you cancel a monthly plan halfway through the month, you retain paid features for the remainder of that month, but will not be charged for the next month.)

  • Changes to Fees: NetDiag reserves the right to change its pricing or introduce new charges for the Service. If prices or terms of a plan change, we will provide advance notice (for instance, via email or on our site) so you can choose whether to continue with the Service. Any price changes will not retroactively affect your current paid period, but will apply upon renewal or upgrading. We aim to keep our plans fair, but if you do not agree to a revised fee, you may cancel before the new prices take effect.

Refund Policy

  • Subscription Refunds: If you encounter an issue with the Service or are unsatisfied, please contact us at [email protected]. We will review refund requests on a case-by-case basis. In general, prepaid subscription fees are non-refundable, but we may issue prorated refunds or credits in cases of service failure, accidental charges, or as required by consumer protection laws.

  • How to Request a Refund: You may request a refund by emailing our support with the relevant account and payment details. Include information that can help identify your account (such as your account email or transaction ID). We will confirm receipt and let you know the outcome of your request.

  • Free Credits or Trial: If NetDiag ever offers free trial credits or promotional usage, those have no cash value and are not refundable. They may expire after a set period. (For example, if we grant free usage to new users, we reserve the right to limit or revoke unused free credits after an expiration date.)

Cancellation & Termination

  • Voluntary Account Closure: You may close your NetDiag account at any time. You can do this through any account settings provided or by contacting support. Closing your account will revoke your API key and access, and we will delete your personal data and any stored diagnostic results associated with your account from our active systems (see Privacy Policy for more on data deletion).

  • Effect of Cancellation: If you cancel a paid subscription, you will not be charged further and your account may revert to the free tier after the paid term ends. We do not provide refunds for unused time in a subscription period except at our discretion (see Refund Policy above). We also reserve the right to delete or anonymize data associated with a canceled account, unless you reactivate it within a certain timeframe.

  • Termination by NetDiag: We reserve the right to suspend or terminate your access to the Service for any reason at our discretion, including (but not limited to) a violation of these Terms, abuse of the Service, non-payment, or if your use of NetDiag poses a security or operational risk. In most cases, we will attempt to warn or notify you of problematic activity and provide an opportunity to correct it, but we are not obligated to do so.

  • Abuse and Violations: Any abuse of the Service will lead to termination of your account. What constitutes "abuse" or violation of these Terms is determined by us (NetDiag) in our sole discretion. Examples include attempting to bypass rate limits, using the Service for attacks, or other activities prohibited in Acceptable Use above.

  • No Refund for Termination: If your account is terminated by us due to a violation of these Terms or misuse of the Service, you will not be entitled to a refund of any fees paid. In other words, if we terminate or suspend you for cause, any remaining paid period (or credits) may be forfeited.

  • Data After Termination: Upon termination of your account (by you or by us), we will delete your data as described in our Privacy Policy. However, please note that residual copies may persist in backups for a short period. We are not liable to you or any third party for termination of your access to the Service or deletion of your data, provided we follow the terms of our Privacy Policy.

  • Discontinuation of Service: NetDiag reserves the right to discontinue or shut down the Service entirely. If we decide to cease operations, we will make a reasonable effort to notify users in advance (e.g., via an announcement or email). After such discontinuation, you may not be able to access the Service or your data, so please plan accordingly if we announce a shutdown.

API Usage & Rate Limiting

  • "As Is" API: The NetDiag API is provided on an "as is" and "as available" basis. While we aim for high uptime and stability, we do not guarantee that the API will always be available, or that it will meet your specific performance needs.

  • API Changes: The API, including its endpoints and response formats, is subject to change over time. We may add, modify, or remove API features as part of ongoing improvement. We will try to version API changes or provide notice when feasible, but we reserve the right to make changes (especially security or performance critical changes) without prior notice. Please periodically check our documentation for updates.

  • Rate Limits: To ensure fair use and stability, the Service enforces rate limits on API requests per tier. You agree to stay within the published limits for your tier. Excessive usage beyond your plan's limits is not permitted. What constitutes excessive or abusive querying is determined at NetDiag's sole discretion.

  • Throttling: NetDiag reserves the right to throttle (slow down) your API requests if you exceed your plan's limits or if your usage patterns negatively impact the service's performance. This may occur automatically. For example, if a Free tier allows N requests/minute and you exceed that, further requests may be delayed or rejected until the rate limit period resets.

  • Temporary Blocks: In cases of extreme overuse or suspected abuse, we may temporarily block API access for your account or IP address. This measure is typically to prevent service degradation. We will restore access when the issue is resolved and you have agreed to comply with limits.

  • Suspension for Abuse: Repeated or egregious violation of API usage policies (for example, deliberately trying to circumvent the rate limits or overwhelming our servers) can result in account suspension or termination as noted above.

  • No Guaranteed Throughput: We do not guarantee that the API will process your requests within a particular time frame. The Service may become slow or unavailable during maintenance or peak load. You should design your integration with tolerance for occasional delays or failures. NetDiag is not liable for any consequences of API outages or slowdowns.

  • Usage Monitoring: You consent that NetDiag may monitor your API usage (e.g., request volume, patterns) to verify compliance with these Terms, improve the service, and for security purposes. We may generate aggregated statistics from usage (which do not identify you personally). See our Privacy Policy for more on how we handle data.

Intellectual Property

  • Ownership: All rights, title, and interest in and to the NetDiag Service (including the website content, API, software, and underlying source code) are and will remain the exclusive property of NetDiag (and its licensors, if any). The Service is protected by copyright and other intellectual property laws. You are not granted any ownership of the Service or its content by using it – only the limited right to use it per these Terms.

  • License to Use: As a user, you have a non-exclusive, non-transferable, revocable license to access and use NetDiag solely for your own internal purposes (or those of your organization) and in accordance with these Terms. You may not resell or redistribute the Service, or create derivative services that compete with NetDiag, without our permission.

  • Prohibited Actions: You must not copy, reproduce, distribute, or modify any part of NetDiag's software or website. You also must not attempt to reverse engineer or extract source code from our software, except to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation. Any attempt to interfere with the proper operation of the Service or to circumvent any security measures is strictly prohibited.

  • Trademarks: "NetDiag" and the NetDiag logo or any slogans are trademarks or service marks of our project. You are not permitted to use these marks without our prior written consent, except as allowed by law (such as for factual references or compatibility). For example, you may not name your application or service in a way that implies endorsement by or affiliation with NetDiag.

  • Open Source Components: Some components of NetDiag might be provided under open-source licenses (for example, certain client libraries or parts of our code if we open source them). Those components are licensed to you under their respective licenses, and nothing in these Terms limits your rights under those licenses. We will provide attribution and license information for any open-source code we release or use, as appropriate. (As of the current version, NetDiag's core code is proprietary, but this may evolve.)

  • Feedback: We welcome feedback and suggestions about NetDiag. However, if you provide feedback to us, you acknowledge that we may use it to improve our service without any obligation or compensation to you. Any feedback you provide is considered non-confidential and non-proprietary.

Disclaimer of Warranties

  • Service Provided "As Is": NetDiag (including the website, API, and all services) is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not guarantee that the Service will meet your requirements, be uninterrupted, timely, secure, or error-free.

  • No Implied Warranties: To the fullest extent allowed by law, we disclaim any and all implied warranties or conditions, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Using an experimental or developer-focused tool like NetDiag means you accept that it might have bugs or inaccuracies, and you bear that risk.

  • Data Accuracy: NetDiag attempts to provide useful network diagnostic information, but we do not warrant the accuracy or completeness of any data or results you obtain through the Service. For example, latency or uptime measurements, DNS or TLS results, etc., are offered on a best-effort basis and may contain errors. You should verify critical results through other means.

  • Service Changes: We reserve the right to modify or improve the Service at any time without liability. This includes adding, changing, or removing features (including enforcing new limits) or updating software. We also reserve the right to discontinue the Service or any part of it (temporarily or permanently) by giving notice as described earlier.

  • No Guaranteed Availability: NetDiag does not guarantee that the Service will be available 100% of the time. Downtimes or outages may occur for maintenance, upgrades, network failures, or other reasons. We will try to minimize disruptions, but we are not liable for any unavailability or loss of data during downtime.

  • Third-Party Services: NetDiag relies on third-party services (e.g., cloud hosting, DNS, payment processing). We make no guarantees on their behalf. You acknowledge that the Service's quality may be affected by these external dependencies. Any references to third-party products or services do not constitute endorsements or warranties by NetDiag.

  • Beta Features: From time to time, we may offer beta or experimental features. These are provided without any warranty and may be changed or removed at our discretion. Use beta features at your own risk.

Limitation of Liability

  • Limit on Types of Damages: To the maximum extent permitted by law, NetDiag will not be liable for any indirect, incidental, special, consequential or exemplary damages arising out of or in connection with your use of the Service. This includes, without limitation, damages for lost profits, lost data, business interruption, goodwill, computer damage, or other intangible losses, even if NetDiag has been advised of the possibility of such damages.

  • User's Responsibility: You expressly understand and agree that any decisions or actions you take based on data or information provided by the NetDiag Service are at your own risk. NetDiag shall not be held liable for any claims or losses due to actions you take (or don't take) in reliance on the Service's results. For example, if NetDiag reports a host as up or down or returns a certain measurement and you act on that, you are solely responsible for the consequences.

  • Maximum Liability: In any case, NetDiag's total cumulative liability to you for all claims arising from or related to the Service will not exceed the amount (if any) you have paid to NetDiag for the Service in the last 12 months. If you have paid nothing (e.g., using the free tier), NetDiag's liability is $0. This limitation applies to all claims of any kind, whether based on warranty, contract, tort (including negligence), or any other legal theory.

  • Jurisdictional Limits: Some jurisdictions do not allow the exclusion of certain warranties or the limitation/exclusion of liability for incidental or consequential damages. If those laws apply to you, some of the exclusions or limitations above may not apply to you. In that case, NetDiag's liability will be limited to the greatest extent permitted by law.

  • Release: You release NetDiag (and our officers, directors, affiliates, employees, and agents) from any and all liability, claims, or damages arising from or related to disputes between users of the Service or between a user and a third party in connection with the use of the Service. We are not responsible for the actions or content of other users or third parties.

Indemnification

  • Your Indemnity to Us: You agree to indemnify, defend, and hold harmless NetDiag and its owners, officers, employees, contractors, and agents from and against any and all third-party claims, demands, losses, liabilities, damages, or costs (including reasonable attorneys' fees) arising out of: (a) your use of the NetDiag service, (b) your violation of these Terms, or (c) your infringement of any intellectual property or other rights of any person or entity.

  • Examples: This means that if a third party (for example, another company, or a network owner) sues NetDiag because of something you did – say, you used NetDiag to attack someone's system, violate someone's rights, or break the law – then you are responsible for the costs and damages incurred by NetDiag due to that claim. You would be expected to step in and defend NetDiag or cover our losses in such a situation.

  • Notification and Cooperation: If we receive a claim for which we will seek indemnification from you, we will notify you promptly of the claim. You agree to allow us to assume the defense of the claim (with counsel of our choosing), or, if we permit you to handle defense, to cooperate fully with us in defending. You further agree not to settle any such claim without our prior written consent, as a settlement might impose obligations on NetDiag.

  • Continued Obligations: These indemnification obligations survive any termination of your account or this agreement. Your duty to indemnify applies even after you stop using the Service, for claims arising from your use when you did use it.

Changes to These Terms

  • Updates to Terms: NetDiag may update or modify these Terms of Service from time to time. If we make changes, we will post the updated Terms on our website (and update the "Last updated" date at the top). The latest Terms will always be available at the Terms of Service page. We may additionally notify registered users via email or an in-service notification of major changes.

  • Acceptance of Changes: Continued use of the Service after an update means you accept the new Terms. If you do not agree with the revised terms, you should stop using NetDiag. We encourage you to review the Terms periodically to stay informed of any updates.

  • Material Changes for Paid Users: If you are a Pro subscriber and a change to these Terms materially affects your rights or obligations, we will make reasonable efforts to notify you in advance (e.g., by email). If you object to the changes, you may terminate your subscription before the new Terms apply, and we may offer a prorated refund for any unused portion of your subscription from the termination date. Otherwise, your continued subscription will signify acceptance of the revised Terms.

Governing Law & Disputes

  • Governing Law: This agreement and your use of the Service will be governed by the laws of Armenia, without regard to its conflict of law principles. All rights and remedies provided in these Terms are cumulative and not exclusive of any other rights or remedies that may be available under law.

  • Jurisdiction: You agree that any dispute or claim arising out of or relating to these Terms or the Service must be resolved by a court of competent jurisdiction in Armenia (unless otherwise required by a mandatory law, such as a law giving consumers the right to bring claims in their local courts). Both you and NetDiag consent to the personal jurisdiction of such courts.

  • Injunctive Relief: Notwithstanding the above, in the event of your unauthorized access to or use of the Service or violation of the Intellectual Property provisions, we reserve the right to seek injunctive (urgent legal) relief in any jurisdiction.

  • International Use: We make no representation that the Service is appropriate or available for use in all locations. If you access NetDiag from jurisdictions where its content is illegal, you do so at your own risk and are responsible for compliance with local laws.

Miscellaneous

  • No Waiver: If we do not enforce a provision of these Terms, it does not mean we waive our right to do so later. For example, if we don't immediately take action on a violation by you, we still have the right to enforce it in the future.

  • Severability: If any part of these Terms is held to be invalid or unenforceable by a court of competent authority, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions, and the remaining portions shall remain in full force and effect.

  • Entire Agreement: These Terms (along with the Privacy Policy and any other agreements expressly incorporated by reference) constitute the entire agreement between you and NetDiag regarding the Service, and supersede any prior agreements or understandings (written or oral) relating to your use of the Service.

  • Assignment: You may not assign or transfer your rights or obligations under these Terms to anyone else without our prior written consent. We may assign our rights and obligations to an affiliate or in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.

  • No Third-Party Beneficiaries: These Terms are solely for the benefit of you and NetDiag. They do not create any rights for any other person, except for permitted successors and assigns under the above provision.

  • Force Majeure: NetDiag will not be liable for any failure or delay in performance of its obligations (including downtime or data loss) if such failure results from factors beyond our reasonable control, including but not limited to denial-of-service attacks, internet outages, hosting provider failures, power failures, or legal restrictions.
